Terms and Conditions

In the following terms & conditions “the photographer” shall mean Ian Richardson trading as Ian Richardson Photography (iRPi). “the client(s)” shall be those persons defined as Client on the booking form. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
1. Copyright
1.1. The Copyright Designs and Patents Acts assign the copyright of the images to the photographer.
1.2. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing.
1.3. The client(s) hereby allow(s) the photographer(s) trading under Ian Richardson Photography (iRPi) to display any photograph(s) covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
1.4. All digital images (computer files) remain the property of the photographer(s). On occasion, the photographer(s) may supply a copy of the edited digital images (computer files) to the client(s) for their own non-commercial use.
2. Licence and Coverage 2.1. The photographer(s) shall be granted artistic licence in relation to the poses photographed and the locations used. Although every effort will be made to comply with the client(s) requirements, the photographer(s) judgment regarding the location, poses and number of photographs taken shall be deemed correct.
2.2. For bookings involving a church ceremony or at certain other venues, photographers(s) movements are sometimes restricted by the minister or official in charge: photographing of parts or even all the ceremony may be restricted or prohibited, as may the use of artificial lighting. The photographer(s) cannot accept responsibility for limited coverage in such cases.
2.3. Whilst the photographer(s) shall endeavour to fulfil all the client(s) requirements, they cannot be held responsible for non-availability of subjects, subjects that are in the background or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain specified shots.
2.4. Any alterations made to the booking by the client(s) once details have been confirmed may only be made at the discretion of the photographer(s). If unable to accommodate alternative arrangements (such as the change of ceremony date or venue) the photographer(s) are not liable to compensate the client(s) in any way whatsoever.
3. Venue
3.1 The photographer(s) will not be held responsible for breakages or damage that whilst at the venue or client(s) residence.
3.2 client(s) will be responsible for full reimbursement/ replacement of any damage to photographic equipment, props or backdrops whilst in or around client(s) property or location shoot due to mis adventure of client(s), client(s) family, client(s) friends or animals in or around the area of the shoot. 3.3 Photographer(s) reserve the right to cancel without notice due to misconduct and/or damage to Property belonging to or representing Ian Richardson Photography.
4. Image Reproduction
4.1. Owing to photo-chromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, the photographer(s) will endeavour to achieve a pleasing overall colour balance based on natural flesh tones.
4.2. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable.
4.3. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.
4.4 Where images are made available for use by the client(s), the default image file will be in the form of Jpegs or PDFs supplied either on USB or CD/DVD or electronic download.
4.5. Where images are made available for use on a DVD player reasonable steps are taken to ensure compatibility, but DVD discs may not play on all DVD players, particularly older models.
4.6. We use only quality branded CDs and DVDs, ensuring each is checked before dispatch, but it remains the responsibility of the client(s) to check discs for in-transit damage. The photographer(s) trading under Ian Richardson Photography (iRPi) cannot be held responsible for damage to equipment resulting from defective media.
4.7 All print and presentation sizes quoted are approximate and subject to the discretion of the photographer(s).
5. Prices
5.1. All standard wedding packages and additional goods specified on the booking form are supplied at the prices ruling on the date of booking.
5.2. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order and subject to extra cost.
5.3 All prices are as at the time of signing the contract, but if changes arise that are outside the photographer(s) control, for instance but not exclusively, the costs of prints, additions, travel, and subsistence, then we will inform the client(s) of such within 21 days after the event.
5.4 Photographs supplied by the photographer(s) after editing are final. any alterations required to be made after the receipt of the photographs by the client(s) are subject to an additional cost, which includes cropping, retouching, photo manipulation (removal of objects and or subjects) the price will vary due to complexity of the image and prices start from £10.00 per image. (please note that prices can go up to £35.00 per image due to the amount of time taken during the editing process). 6. Booking Fee/Deposit Payments for weddings
6.1.A non-refundable booking fee of £250.00 as well as full acceptance of the terms and conditions as published on Ian Richardson Photography (iRPi) website secures the time and services of the photographer(s) for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.
6.2. The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due. Payment in full of the remaining balance will be due two calendar months before the wedding day. Weddings that are postponed to a later date will retain the fee if the photographer(s) can re-schedule for the new date and time.
7. Force Majeure
7.1. The due performance of the contract is subject to alteration or cancellation by the photographer(s) owing to any cause beyond their control (i.e. sudden illness/injury) or act of god.
7.2. The photographer(s) have other professional photographers who will be contacted by their staff (or family) if they are not able to attend your booking due to clause 7.1.
7.3 In the event of cancellation by the photographer(s) (although all attempts will be made to arrange for another photographer(s) to be present – see clause 7.2.). The photographer(s) liability shall be limited to a full refund of any deposits and fees paid.
8. Cancellation by client
8.1. If the client(s) should have to cancel a booking the following cancellation fees (as may be appropriate to their case) will become due immediately upon said cancellation.
8.2. Cancellation within one week of the booking date and no more than two complete months to go until contracted event date will incur a £250.00 non-refundable booking fee.
8.3 Cancellation with less than two complete months to go until contracted event date will incur the cost of the full price of the complete package booked.
8.4 In all cases where the photographer can rebook the date with an equivalent booking, then the cancellation fee will be reduced to the non-refundable booking fee only and any additional cancellation fees already paid will be refunded accordingly. The said sum shall be payable as compensation as an estimate of the loss the photographer(s) would suffer.
8.5 The client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of any cancellation.
9. Complaints.
9.1 The photographer(s) must be notified in writing (sent by special delivery or email) within two working days of the client(s) being in receipt of their order in the case of error, shortage or damage as mistakes cannot be rectified after this period.
10. Personal accident.
10.1 Personal accident Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer or Dream Day Photography cannot be held responsible for any personal injuries or accidents caused or sustained during a photographic shoot.
11. On the Day, Optional Morning and Evening Cover.
11.1. The photographer(s) trading under Ian Richardson Photography (iRPi) or contract to, is/are the only authorised and official photographer(s) for your wedding day.
12. Images.
12.1. Although Ian Richardson Photography (iRPi) use the latest technology in image capture and recording media, we cannot be held responsible for any data or image corruption or loss during an event due to equipment failure.
12.2 Ian Richardson Photography (iRPi) will however carry back up equipment and media as standard practice to minimise the risk of any failures unforeseen.
12.3. We will endeavour to back up all images taken throughout the day to a master drive while on location. 13. Charges.
13.1 All prices and charges are supplied at www.irpimages.co.uk and are subject to change at any given time.
13.2 Custom package pricing not listed on Ian Richardson Photography (iRPi) website must be agreed by both parties at the time of booking.
14. Subcontracting.
14.1 If there is more than one wedding on a given day or videography is required Ian Richardson Photography (iRPi) may require subcontracting, if this is the case the client(s) will be notified on the day of booking. Ian Richardson Photography (iRPi) cannot be held responsible for any images or videos received back via the subcontractor. The client(s) will have to take any compliant up directly with the relevant subcontracting parties.
15. Third Party Printing.
Ian Richardson Photography (iRPi) cannot accept any responsibility or liability for colour balance or quality of any prints reproduced from the USB Memory Stick that we supply by third party printers such as high street photo processing shops or online photo processing shops.
16. Travel.
16.1 Travel and Subsistence For attendance at venues at a distance over 15 miles radius of DE24 8NZ, travel costs at the rate of £0.44 per mile will be charged where appropriate. Where the wedding and ceremony require an overnight or longer stay, whether in the UK or abroad, then hotel and subsistence charges will be made.
17. Delivery of edited photographs and albums and prints.
17.1. Due to the time it takes to edit photographs taken at the event the wait time for the client(s) for delivery of images on USB or CD/DVD can be up to two calendar months.
17.2 Once the edited, photos have been agreed for placement in the photo album or for printing by both the photographer(s) and the client(s) there will be a further wait time up to one calendar month before you chosen album or prints are received (due to third party processing times).
17.3 Ian Richardson Photography (iRPi) will however endeavour to deliver your images as soon as possible.
18. Payments.
18.1. Payments accepted are Cash/Cheque/PayPal.
18.2. Cheques are to be made payable to (Ian Richardson Photography)
19. Country of Jurisprudence.
19.1 This Contract is made under, and subject to, English Law. By signing below the client agrees to all terms and conditions listed in this contract which has been set out by the photographer(s) working for or contracted to Ian Richardson Photography (iRPi).
20. Privacy.
20.1 Ian Richardson Photography (iRPi) will store your name, wedding details and images on a private internal database. These details will not be made available to companies or individuals outside of Ian Richardson Photography (iRPi). Should you wish to have your details removed from our database, please advise, Ian Richardson Photography (iRPi) in writing by email to irpimages68@gmail.com.
20.2 Images cannot be removed from our database as Ian Richardson Photography (iRPi) reserves the right as covered in section 1 (Copyright). of this agreement to retain any images taken by the photographer(s).
21. Vouchers.
21.1 Gift Vouchers are valid for one year from date of purchase.
21.2 Gift Vouchers are only valid for use within a radius of 40 miles of Derby, Derbyshire, uk.
21.3 Gift Vouchers are non refundable and cannot be exchanged for cash.
21.4 Gift Vouchers must be presented at the time of purchase.
21.5 Gift Vouchers are not valid without the genuine 'iRPi' sticker.
